Interview with Steve Bliss, Escondido Probate Attorney

Steve, thanks for taking the time to chat with us today about probate and estate planning

It’s my pleasure to be here. I’m always happy to talk about helping people protect their families and legacies.

Can you explain what a testamentary trust is and how it works?

A testamentary trust is a type of trust that is created through your will and only comes into effect after you pass away. It’s important to note that unlike a living trust, a testamentary trust goes through probate. This means the court oversees its distribution.

Now, why would someone choose a testamentary trust? They’re particularly useful when you have minor children or beneficiaries who may need help managing their inheritance. For example, let’s say you want to ensure your child receives their inheritance gradually as they reach certain ages, rather than getting a lump sum all at once.

You can specify these terms within the testamentary trust. A trustee, whom you designate in your will, would then manage the assets and distribute them according to your instructions. Testamentary trusts provide a level of control and protection that can be invaluable for families in certain situations.

Have you ever encountered any challenges with setting up or administering testamentary trusts?

While testamentary trusts are effective tools, they do require careful planning and attention to detail. One situation I recall involved a client who hadn’t clearly outlined the terms of distribution for their trust. This led to some disagreement among the beneficiaries after their passing.

Consequently, it highlighted the importance of open communication and precise language when drafting these documents. I always encourage my clients to consider all possible scenarios and discuss their wishes thoroughly with their loved ones.

That makes sense. What advice would you give to someone considering a testamentary trust?

Ordinarily, I recommend consulting with an experienced probate attorney like myself. We can help you determine if a testamentary trust is the right fit for your needs and guide you through the entire process. Remember, estate planning is not a one-size-fits-all endeavor; it’s about creating a personalized plan that reflects your unique circumstances and goals.
